The nomination of Judge Gorsuch to the U.S. Supreme Court is both alarming and deeply concerning to LGBT Pennsylvanians.
Judge Gorsuch's troubling judicial record most notably includes his decision in Hobby Lobby, where his ruling allowed the personal religion of a business owner to trump the civil rights of their employees. If this horrendous ruling isn't disqualifying enough, Judge Gorsuch joined a 2015 decision in Druley Vs. Patton where he rejected the discrimination suit of an incarcerated Transgender woman who was suing to receive medically-appropriate care. The ruling stated “To date, this court has not held that a transsexual plaintiff is a member of a protected suspect class for purposes of Equal Protection claims.”
We believe a 9th justice is needed on the Supreme Court. But we also believe that the court should be comprised of fair minded judges without records of anti-LGBT rulings. In short, we state loudly and clearly that the LGBT community objects to the Gorsuch nomination, and we implore Senator Casey and Senator Toomey to do the same.
